Terms of Service

These Terms of Service (“Terms”) govern your access to and use of starveilbuild.com (the “Site”) and the manufacturing services provided by StarveilBuild (“we”, “us”, or “our”). By accessing the Site or requesting a quote, you agree to be bound by these Terms. If you do not agree, please do not use our Site or services.

1. Eligibility

This Site is designed for business-to-business (B2B) professionals, including builders, contractors, architects, developers, and distributors. By using this Site, you represent that you are acting in a commercial capacity and have the authority to bind your organization.

2. Quotations and Orders

  • All quotations issued by StarveilBuild are valid for 30 days from the date of issue, unless otherwise stated.
  • Quotations are based on the specifications, quantities, and delivery terms provided by the buyer. Changes to specifications after quotation may result in revised pricing.
  • An order is confirmed only upon receipt of a signed purchase order or proforma invoice and the agreed deposit payment.
  • Production lead times are estimates based on current capacity. StarveilBuild is not liable for delays caused by force majeure, customs clearance, or third-party logistics.

3. Product Specifications and Compliance

  • All product specifications (dimensions, performance ratings, materials) are based on standard manufacturing tolerances and published technical data.
  • StarveilBuild manufactures products engineered to meet published standards (e.g., DP50, ASTM E1886, AS2047, EN 14351-1). Test specimens and full documentation are available for buyer-funded certification under the buyer’s brand.
  • The buyer is responsible for verifying that products meet local building codes and project-specific requirements before placing an order.
  • StarveilBuild does not hold certifications (NOA, ENERGY STAR, CE Mark, NFRC) in its own name. Certification-ready documentation is provided for the buyer’s independent certification process.

4. Pricing and Payment

  • All prices are quoted in USD unless otherwise specified. Prices are FOB Foshan, China, unless alternative Incoterms are agreed.
  • Standard payment terms: 30% deposit upon order confirmation, 70% balance before shipment. Letter of Credit (L/C) is accepted for orders exceeding USD 50,000.
  • Tooling and custom profile charges, if applicable, are one-time fees and are non-refundable once production begins.

5. Shipping and Delivery

  • Shipping methods (FOB, CIF, DDP) are specified in the proforma invoice. The buyer is responsible for import duties, taxes, and customs clearance unless DDP terms are agreed.
  • Products are packaged in ISPM-15 compliant crates suitable for international shipping. The buyer should inspect goods upon receipt and report damage within 7 days.
  • Title and risk of loss pass to the buyer when goods are loaded onto the vessel at the named port of shipment (FOB terms) or as specified by agreed Incoterms.

6. Warranty

StarveilBuild provides a 10-year warranty against manufacturing defects in aluminum profiles and hardware, and a 5-year seal warranty, subject to the following conditions:

  • Products must be installed in accordance with the provided installation guidelines.
  • Warranty does not cover damage caused by improper installation, misuse, modification, or acts of nature.
  • Claims must be submitted with photos and a description of the defect within the warranty period.
  • Remedy is limited to repair or replacement of the defective component, at StarveilBuild’s discretion.

7. Intellectual Property

All content on this Site — including product designs, technical drawings, specifications, images, and text — is the property of StarveilBuild or its licensors and is protected by intellectual property laws. You may download and use technical resources (CAD, BIM, spec sheets) solely for project evaluation purposes. Redistribution or commercial use of Site content without written permission is prohibited.

8. Confidentiality

Any drawings, specifications, or project details shared between the buyer and StarveilBuild are treated as confidential information. Neither party shall disclose such information to third parties without the other’s consent, except as required by law or for the purpose of fulfilling an order.

9. Limitation of Liability

To the maximum extent permitted by law, StarveilBuild’s total liability arising from or related to these Terms or any order shall not exceed the total amount paid by the buyer for the specific products giving rise to the claim. StarveilBuild is not liable for indirect, consequential, or incidental damages, including loss of profits or project delays.

10. Force Majeure

StarveilBuild is not liable for failure or delay in performance caused by events beyond its reasonable control, including natural disasters, pandemics, government actions, labor disputes, supply chain disruptions, or transportation failures.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the People’s Republic of China. Any dispute arising from these Terms shall first be resolved through good-faith negotiation. If unresolved within 60 days, the dispute shall be submitted to arbitration at the Foshan Arbitration Commission in accordance with its rules. The language of arbitration shall be English.

12. Changes to Terms

We may revise these Terms at any time. The “Last updated” date indicates the most recent revision. Continued use of the Site after changes constitutes acceptance of the updated Terms.
